TERMS AND CONDITIONS
Contest “GIVEAWAY FESTIVAL CEREMONY with YOVERSE”
ONLY PEOPLE OF LEGAL AGE MAY PARTICIPATE.
1. DESCRIPTION OF THE COMPETITION:
The “CEREMONIA FESTIVAL GIVEAWAY” Contest (hereinafter referred to as “the Contest”) is a contest organized by YONDER MEDIA MOBILE MÉXICO, S. DE R.L. DE C.V (YOVERSE or the Organizer) through the mobile application called YOVERSE, which requires Participants (as defined below) to demonstrate their interest in current music, by visiting different bars in Mexico City to win two general passes to the festival called "Ceremonia Festival" that will take place in Parque Bicentenario, CDMX, Mexico on April 1 and 2, 2023 (the “Prize”).
2. STEPS OF THE COMPETITION:
To enter the Contest, Participants (each an “Participant” or “Participants”) must meet the following criteria:
2.1. The Participant must be of legal age according to current Mexican legislation and be able to participate physically in Mexico City;
2.2. Participants must a) download the YOVERSE application b) accept the terms and conditions of use thereof, as well as the Privacy Notice; c) create an account or login to your account if you already have one;
2.3. The Participant must have a mobile phone or device that can detect and open QR codes.
2.4. Subsequently, the Participants must recognize that they must watch the ALAMEDA program within the YOVERSE mobile application to understand the second stage of the competition and to be able to continue participating.
Participating is very easy, once the above requirements are met, Participants must:
1. From February 14, 2023 to March 21st of the same year, visit one of the following places i) Café Tacobar ii) Luvina Vegan Bar iii) Pizza Rossopomodoro; which are located in Mexico City.
2. In each of the aforementioned places, Participants must search for and scan the special QR code and collect an NFT which is added to their blockchain wallet within their profile in the YOverse app.
3. To go to the second stage, Participants must collect the free NFT from one of the three aforementioned places and it must be visible on your profile in the YOverse app.
3. SECOND STAGE AND ANNOUNCEMENT OF THE WINNERS:
The Participants who are eligible to participate in the second and final stage of the contest, having followed the steps described above, will be announced on March 21st, 2023, in the ALAMEDA Show between 7:00 p.m. and 9:00 p.m., through the YOVERSE application.
Once the Participants for Stage Two have been decided based on completion of the steps in Stage One, the final steps to win will be shared in the ALAMEDA show on March 21st. In the event that any chosen Participant does not continue with stage two of the Contest, they will not be able to claim any prize.
The Organizer may record the final giveaway dynamic and selected Participants.
4. ABOUT THE PRIZE:
The two Official Winners will each receive TWO TICKETS TO CEREMONIA FESTIVAL as a Prize on April 1 and 2, 2023, at PARQUE BICENTENTARIO in Mexico City.
Participants who reach the second stage but are not one of the two Official Winners may not claim any prize. No changes or transfer of the Prize are allowed except by YOVERSE's decision, which reserves the right to substitute a Prize for another of equal or greater value. Any type of substitution of the Prize or exchange for cash is not allowed. All expenses related to the use of the Prize, transfers, expenses within the festival or any other will be borne by the Official Winners and will be their exclusive responsibility.
YOVERSE will not replace any Prize that has been lost or stolen after it has been delivered to the Official Winners; nor will it be responsible in case it is never picked up. YOVERSE will not give the Participants and/or Official Winners any other payment, benefit, good or service other than those detailed in these Terms and Conditions.
The Official Winners will be responsible for collecting their Prize at the address indicated by YOVERSE before the festival date. The prize delivery expenses will be borne by each of the Official Winners. YOVERSE will not be responsible when any of the Official Winners of the Prize cannot receive the Prize, use the Prize for any reason, act of God, force majeure or act of the government, or when the Official Winners lose or waive their right to claim the Prize in accordance with these Terms and Conditions; in both cases the Official Winners will lose all rights they may have in relation to the Prize.
5. RESPONSIBILITY
YOVERSE and/or its affiliates and/or subsidiaries will not be responsible for failures in the QR codes, the NFTs or in the Prize or the use of the Prize, nor for the defects or vices that the Prize may have, nor for human errors or deliberate actions of third parties that could interrupt or alter the normal development of the Contest and/or due to failures in the device used to participate and/or the exchange or use of the Prize.
Regardless of the provisions included in other sections of these Terms and Conditions, by mere participation in the Contest, Participants agree to waive, release from liability, indemnify, protect and hold YOVERSE and its corresponding parent companies, affiliated companies free from all liability. and subsidiaries, located in the country or abroad, permanently and irrevocably, against any claim for loss or damage (including injury, disability and death) affecting or declared to have affected any person or property, loss, cost and expense of any kind and nature and for this purpose releases YOVERSE from all liability and claims that may arise or derive in whole or in part, directly or indirectly, in relation to: (i) participation in this Contest and the Prize ; (ii) the interpretation of these Terms and Conditions or any determination or interpretation of YOVERSE, (iii) the use, mention or publication (correctly or incorrectly) of any name, information or characteristic of a Participant, and waives any claim based on intellectual property rights (including moral rights), publication and image rights, defamation and privacy rights for the use and publication of such information; (iv) caused by any failure in the connection to read the QRs or download NFTs, as well as electrical or electronic failures that may arise during your participation; or in general, due to technical defects in the telephone network, mail, computer communication networks, online computer systems, computerized date mechanisms, computer equipment, software, or any other combination thereof, that prevent, affect or delay participation in the Contest, collection or transmission of information, notification or verification processes as well as for reasons of any damage to the computer and/or its content owned by the Participant or third parties, resulting from or related to this contest, including, among others, during the time of participation, downloading or sending information or material to the Contest or when browsing the Website; (v) entry error or any other type of error contained in the Terms and Conditions or in the transmission or announcement of each of the Official Prize Winners, as long as the applicable law allows it.
This Contest is not related in any way to Festival Ceremonia, so the rules and Terms and Conditions of this contest will be managed independently. YOVERSE does not have a license for use, transfer or any other analogous with the festival, being two completely independent organizations.
YOVERSE employees, officers, directors, and contractors are excluded from participating in the Contest.
The Participants must meet the necessary requirements to be Official Winners of the pass to the Ceremony festival, in accordance with the provisions of these Terms and Conditions, otherwise the pass will not be delivered and another Participant will be determined as the winner.
Entrants who violate these requirements may be deemed ineligible to receive the Prize and may be disenrolled at the sole discretion of YOVERSE.
YOVERSE reserves the right to disqualify, at its sole and absolute discretion, any entry that it deems inappropriate or that does not comply with the terms of the YOVERSE Mobile Application. YOVERSE reserves the right to modify any aspect of this Contest, without further liability to the extent permitted by law. Incomplete entries will be disqualified.
YOVERSE reserves the right to determine, at its sole discretion, whether
Participants have met the participation requirements. Ensuring the correct reading of the QR Code will be the sole responsibility of the Participant. YOVERSE will not be responsible for any information of the Participant that has been declared false.
6. PRIVACY POLICY:
YOVERSE will collect the personal information submitted by the Participants in accordance with its data protection policy (hereinafter the "Personal Data"). The Personal Data obtained from the Participants will be treated in accordance with the Privacy Notice contained in the YOVERSE application, which will be the obligation of the Participants to comply with and respect. The Participants will be able to verify the Privacy Notice of YOVERSE, the details for the exercise of the rights of ARCO and the conditions of their treatment.
YOVERSE may record, monitor and use the Personal Data of the Participants for the purposes of this contest, and later for the publicity of other YOVERSE events, programs or products. YOVERSE does not sell, rent or lease to third parties the Personal Data provided by the Participants. Occasionally, Personal Data may be provided to other companies that work on behalf of YOVERSE. By participating in this contest you expressly accept and authorize the Organizer to use your Personal Data with the aforementioned scope.
7. GENERAL CONDITIONS:
To the extent permitted by applicable law and to the fullest extent permitted, Participants agree to waive any right they may have to make any claim against YOVERSE due to any ambiguity or error in the Terms or for any element of the Contest, and agree to be subject to these Terms and Conditions and the decisions of YOVERSE, which will be final and binding in all its aspects.
If permitted by applicable law, YOVERSE will not be responsible for errors or qualification adjustments. All ratings are final. In the event of a dispute over the identity of any Participant, YOVERSE reserves the exclusive right, but without obligation, to consider another Participant who has been announced for the second stage as the Official Winner. YOVERSE shall have the right to demand proof of identity from the Participant for any purpose related to the Contest. Anyone attempting (by any means) to defraud Organizer, Released Parties and/or their agents or attempting to rig the contest in any way or in any aspect of this Contest will be disenrolled and will lose all rights to participate. in the Contest and/or any future contests run by YOVERSE (at its discretion) and you will not be entitled to receive the applicable Prize.
YOVERSE reserves the right, at its sole discretion and to the extent permitted by law, to cancel, delay or modify the Contest or any part thereof, and to conduct the Contest with accepted YOVERSE whose details are already entered, without liability or obligation to any other Entrant, present or future, when for any reason the Contest cannot be conducted as planned, for any reason beyond their control, which may affect the administration, security, fairness, integrity or proper operation of the Contest, or for for any other reason that it deems appropriate in its sole and complete discretion, including, but not limited to, failure, defect, or technical or human error or unauthorized intervention, programming errors, hacking, force majeure, or other causes. YOVERSE's or its agents' failure to comply with the terms and conditions of the Contest due to force majeure shall not be considered a breach or breach of the Contest. This Contest and its Terms and Conditions are not subject to negotiation with the Participant.
Participation in this Contest does not create any type of relationship or labor responsibility between the Participants and YOVERSE, therefore, there is no responsibility for the social security of the Participants on the part of YOVERSE.
The Contest and the interpretation of these Terms and Conditions are subject to the laws of Mexico. Participants agree to submit to the exclusive jurisdiction and jurisdiction of the courts of Mexico City, for all claims related to this Contest.
8. ACCEPTANCE OF THE RULES:
Participation in this contest implies knowledge and acceptance of these Terms and Conditions, as well as the decisions that YOVERSE adopts on any matter not provided for in them. YOVERSE reserves the right to modify unilaterally, without prior notice or communication, these Terms and Conditions, without this generating the right to claim or compensation in favor of the Participants.
9. PUBLICITY OF THE TERMS:
These Terms and Conditions will be published at www.yoverse.com or in the YOverse App.
